ACKNOWLEDGEMENT AND CONSENT

  1. Primary Consent: By checking the available consent box and/or by continuing to use this platform, the User explicitly acknowledges having read, understood, and agreed to all provisions in our Privacy Policy and expressly grants Us consent to process the Personal Data and Company Data in accordance with said provisions.
  2. Third-Party Data: If the User provides Personal Data relating to other individuals (e.g., staff, cargo representatives, or business partners), the User represents and warrants that they have obtained the valid consent of such individuals for the Processing of their Personal Data by Us. We reserve the right to request proof of such consent at any time.
  3. Confidentiality Obligation of Other Users' Data: The User undertakes to use the Personal Data of other Users or Partners received while utilizing the Application solely for the purpose of service usage. The Booker shall be fully responsible for any misuse of Personal Data committed and shall indemnify Us against all liabilities related to such misuse.
  4. Withdrawal of Consent: The User may withdraw consent for the Processing of Personal Data or consent to receive marketing communications at any time, by providing reasonable written notice. The User understands and acknowledges that such withdrawal of consent may result in the inability to further use the Application or Our services, including the cessation of services or account termination, while still fulfilling all accrued rights and obligations.

DATA WE COLLECT

We collect data to support our services. This data is collected when the User registers, uses the services, and/or communicates with us.

The types of data we collect to support our services are:

  1. Company Identity Data: Company name, business type, number and copies of licensing documents (NIB, related Business License, etc.), Taxpayer Identification Number (NPWP), and office address.
  2. Contact and Personal Data: Full name, position/title, email address, contact person phone number, and address.
  3. Financial Data: Bank account information for Fee payment processing and/or transaction settlement.
  4. Service-Related Data (Vessel Owner): Vessel details (name, size, capacity, type, flag, certification, operational permit documents).
  5. Service-Related Data (Cargo Owner): Cargo details (type, volume, weight, port of loading/unloading, shipping date).
  6. Technical Data: System logs, IP address, device, cookies/similar technologies.
  7. Vessel Location/Tracking Data (If activated/available): AIS signal and other legitimate location data.
  8. Payment Data: Payment method, proof of transaction.
  9. Document Signing Legality Data:
  • Related to Electronic Signature and Electronic Stamp Duty: Data required to ensure the validity of the document and that the signing is performed legitimately.
  • Related to Wet Signature and Physical Stamp Duty: We store the documents or data that the User uploads to the Platform after being manually signed. This data is used to ensure that the contract document uploaded by the User is correct, complete, valid, and meets the requirements for Physical Stamp Duty.

LEGAL BASIS AND PURPOSE OF DATA PROCESSING

  1. The Processing of Users' Personal Data and Company Data is carried out based on:
  2. Explicit Consent: The User's consent upon registration and agreement to this Privacy Policy.
  3. Fulfillment of Agreement: The performance of Our rights and obligations under the T&C.
  4. Legal Obligation: Compliance with prevailing laws and regulations in Indonesia.
  5. Our Purposes for processing User Data are:
  6. facilitate and manage User accounts and the Services.
  7. connect Vessel Owners and Cargo Owners, and to process transactions and Fees.
  8. verify and validate the identity and documents of the Users.
  9. provide customer support and respond to inquiries.
  10. conduct marketing, promotion, and Service development activities (with prior consent).
  11. comply with legal obligations, including reporting to the competent authorities.

SHARING DATA WITH THIRD PARTIES

We reserve the right to share the Personal Data of the Requester and/or Company Data (as applicable) with third parties to the extent necessary for the Platform's operations and the fulfillment of services. Such third parties include, but are not limited to:

  1. Transaction and Support Partners: Payment/escrow providers, banks, financing institutions, insurance companies, Know Your Customer (KYC) or Know Your Business (KYB) service providers, tracking providers, and information technology infrastructure providers.
  2. Key Business Partners: Cargo Owners, Vessel Owners, and/or authorized parties directly involved in the User's transactions on the Platform.
  3. Government Authorities: Government authorities, law enforcement agencies, or regulatory bodies, in accordance with applicable legal obligations and provisions.

We also require all such third parties to comply with reasonable and relevant data security and confidentiality standards.

CROSS-BORDER DATA TRANSFER

Where the Processing or storage of Personal Data occurs outside the territory of the Republic of Indonesia, We will take the steps required by the applicable laws and regulations, including providing notification to the Requester if legally required.

DATA RETENTION

We will retain User Data for as long as necessary to fulfill the data processing purposes or for the duration required by the applicable laws and regulations, after which the data will be securely deleted or anonymized.

USER RIGHTS REGARDING DATA

The rights of the User are subject to the relevant laws and regulations applicable in Indonesia. The User shall have the right to:

  1. Access and Copy of Data: The User may request access to and a copy of the data We process, which will be handled on a case-by-case basis. We may charge a processing fee and request additional verification for security reasons. Certain Data may be excluded due to legal or operational retention requirements.
  2. Correction/Rectification of Data: The User has the right to request the rectification of inaccurate or incomplete data. We provide a [............] option on the Application/Website for updating most details. Rectification requests pertaining to Bookings made with the Vessel Owner will be subject to the respective Vessel Owner's policies.
  3. Account and Data Deletion: The User may submit a request for Data deletion or account cancellation through the available features. The User acknowledges that certain data may remain stored for a specified period in accordance with legal obligations (taxation, financial, etc.) or Our operational needs. We will ensure that such data is destroyed or anonymized once these legal obligations cease.
  4. Objection and Restriction: The User may submit a reasonable objection to the use of certain Data or request the restriction of its processing (e.g., when the Requester disputes the accuracy of the data). We will evaluate such objections, but the objection shall not apply if the processing is legally mandated or necessary to fulfill the contract with the User. While the restriction is in effect, We may be unable to provide certain Products and Services.
  5. Withdrawal of Consent: The User may withdraw consent for the Data Processing at any time if such Processing is based on the User’s consent. Such withdrawal shall not affect the legality of the data Processing that has been carried out previously. The withdrawal of consent may hinder Our communication regarding offers and services.
  6. Request Procedure: All requests pertaining to these rights will undergo an identity and authority screening and verification process of the User. We will review and process acceptable requests within the timeframe stipulated by the relevant law.
  7. Submission of Complaints: If the User is dissatisfied with Our response to the complaint submitted, the User shall have the right to lodge a complaint with the competent local data protection authority.

DATA SECURITY

We are committed to consistently implementing Our best efforts to protect and secure User Personal Data from unlawful access, disclosure, or processing, as well as the risk of accidental loss or damage.

The User acknowledges that data transmission over the internet cannot be absolutely guaranteed to be secure. Therefore, We do not fully warrant that Personal Data will not be intercepted, accessed, or disclosed by unauthorized third parties due to factors beyond Our control.

If a Data protection failure occurs that has a significant impact on the User, We will notify the User and/or the relevant authorities in writing no later than 3x24 hours from the time such failure is known.

The User is fully responsible for maintaining the confidentiality of their account, including the password held. The User is obligated to secure the device used in the data input process and not to share account details with any party.

COOKIES & SIMILAR TECHNOLOGIES

We utilize cookies and/or Software Development Kits (SDKs) for the purposes of core Platform functionality, performance analytics, and enhancing User experience. Users can manage preferences regarding the use of these technologies through browser settings or the cookie preference center available on Our Platform (if applicable).

MINORS

The Services are not intended for individuals below the minimum age limit stipulated by the applicable laws and regulations. We will not knowingly collect the Personal Data of minors because this Application is specifically designed for Individuals and Legal Entities who possess the legal competence to act and/or make decisions.

AMENDMENTS TO THE PRIVACY POLICY

We reserve the right to amend or update this Privacy Policy at any time to reflect changes in Our practices or law. Notification of material changes will be announced through the Application. By continuously using the Application, the User is deemed to agree to the updated Privacy Policy.
